Is it legal for my supervisor to tell me not to take lunch break because it will prevent me from ?

getting promoted and getting a raise?

My supervisor has been with the company for over 17 years. I am sharing an office with her. At the very beginning, I had a superb working relationship with her. I had never taken lunch break or mini breaks even though I was entitled to those breaks. After working there for two years, I started taking my half hour to one hour lunch break, and 2 10 minutes mini break at 10 o'clock in the morning, and 3 o'clock in the afternoon. (These rules are clearly stated on my employee manual, and I believe they are protected by California labor law.)

Yesterday, my supervisor had a talk with me.She told me %26quot;I have noticed you have been taking way too many breaks, and you never had to take those breaks before. Something has certainly changed, your working attitude has certainly changed. It will be very hard for you to get promoted or getting a raise.%26quot;

I told her %26quot;well, I am entitled to these breaks, and they are protected by California labor law.%26quot; She didn't say anything after that.

16 hours you (4) 15 minute breaks (paid) and (2) 30 minutes breaks (unpaid)

this person is just throwing there dummy out the window
u have every right to do that/ good job sticking up for yourself. if she bothers you anymore just talk to her boss and bring up, once again, what the law entitles you as a working individual.
Legal/shmegal. Find another job. That place sucks. I would not be able to work at a place where my performance is meassured on wheter or not I take a break. As matter of fact I am currently at work and nobody cares that I am answering Yahoo right now. They care that I get the products I am hired to do and yes I do get those products. To ask for anthing else is BS.
I'd suggest you find a new job. sounds like she is going to try to hold this against you come review time.
It almost sounds like a threat from your super. I believe the law is 15 min break for every 4 hours worked. But you might want to file a complaint with human resources so there will be a paper trail if it comes down to it.
If the law states you are allowed to have certain breaks then there is nothing your superior can do about it. If she/he thinks she can then report her to the authorities. It will be the company who is in trouble if these laws are not adhered to.
You are legally entitled to those breaks and meal periods.



The company I work for forces us to take our rest periods because they can get fined up to $10,000 for every violation!



Call the 1-800 number in your employee handbook if your supervisor continues with her shenanigans.
